This privacy notice applies to the processing of the personal data of TIER employees and TIER service providers. TIER adheres to the requirements of the General Data Protection Regulation (GDPR) when processing personal data.

1. What data we collect

We collect and process the following data:

  • Name
  • Identification data
  • Address details
  • Salary details
  • Marital status
  • Visa and work permit details (if applicable)
  • Employment contract and other internal contracts
  • Leave data

Additionally, by using the NEST app, we collect and process the following data:

  • Email address
  • Account creation date and time
  • Phone number
  • Location
  • User status
  • Date and time of last access
  • Account status

2. How we collect your data

You directly provide TIER with the data we collect. We collect data when you or your company provide it to us to fulfill your employment contract and when you use our NEST app.

3. How we use your data

TIER collects your data so that we can:

  • Pay your salary
  • Schedule your shifts
  • Show you nearby vehicles
  • Register changes you make to TIER vehicles
  • Satisfy tax obligations
  • Maintain security standards 

4. How we store your data

TIER securely stores your data at Amazon AWS Frankfurt.

TIER will not store your personal data for longer than is strictly necessary for the purposes for which your personal data were collected. We will only store your personal data for longer if we are required by law to do so. In concrete terms, this means that we will store your salary data and contract details for 10 years on account of tax-related reasons. Other data, such as your leave data, performance assessments, or visa details will be erased within 2 years after you leave the company.

5. Processing by third parties

TIER will not sell your personal data to third parties, and we will only disclose them to third parties if necessary, for the performance of our contract with you, for analytical and marketing purposes, operations, or to comply with legal obligations.

Your personal data may be shared with the following parties:

  • Software providers
  • Implementation partners     
  • Professional consultants
  • Payroll companies
  • Pension authorities
  • Parties that manage or run share or option schemes for employees
  • Visa and tax authorities
  • Insurance companies
  • Social security agencies

 Whenever we instruct third-party companies to process your personal data on our behalf, we will enter into a data processing agreement to guarantee the same level of protection and confidentiality of your personal data. TIER will then continue to have ultimate responsibility for such processing operations.

6. Your data protection rights

TIER would like to make sure you are fully aware of all your data protection rights. Every employee and service provider is entitled to the following:

Right to Access - You have the right to request TIER for copies of your personal data or details about how it is collected, processed, stored and secured.

Right to Rectification - You have the right to request that TIER correct any information you believe is inaccurate. You also have the right to request TIER to complete information you believe is incomplete.

Right to Erasure - You have the right to request that TIER erase your personal data, under certain conditions.

Right to Restrict Processing - You have the right to request that TIER restrict the processing of your personal data, under certain conditions.

Right to Object to Processing - You have the right to object to TIER’s processing of your personal data, under certain conditions.

Right to Data Portability - You have the right to request that TIER transfer the data we have collected to another organisation, or directly to you, under certain conditions.
